3. RETURN & REFUNDS
Any item can be refunded if it is returned within 30 days of purchase.
To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
Unfortunately we do not offer a refund on opened or used products and do not offer exchanges online. Likewise, we do not accept returns or refunds for frank body purchases bought in-store.

The TINKTURA website www.itspopjoy.com may be used for your private, non-commercial purposes without any usage fees, under the following terms and conditions. By using the Tinktura.com online store, you agree to comply with these terms and rules.
The supplier of the ordered goods is tinktura d.o.o. of Zagreb. Through the online store, tinktura d.o.o. enables the purchase of the entire range of goods offered on the website. The offer consists of handmade cosmetic products and herbal dietary supplements.
A buyer is any person who electronically orders at least one product, fills in the required information, and successfully submits it through Registration. Registration allows storing data that will be used for contact, delivery, or for advertising information about our products, new products, promotions, and discounts. Registration also ensures simpler and easier order processing later on.
All prices are expressed in the Croatian national currency, the Croatian kuna (HRK), including VAT, and in euros (EUR), at the legally defined exchange rate 1 EUR = 7.53450 HRK.
We advise users to read these Terms before purchasing and to check them regularly, so they are familiar with all rights and obligations. tinktura d.o.o. reserves the right to change these Terms at any time without prior notice and will not be liable for any possible consequences arising from such changes. Use by children or minors is not allowed; parents and/or guardians are obliged to ensure compliance, otherwise they assume all rights and obligations arising from such use, and tinktura d.o.o. is not responsible for any consequences of such use.
NOTE: Tinktura.com does not guarantee that product photos fully correspond to the actual appearance of the product. We are not responsible for any unintentional errors in product descriptions. Differences between the actual product and product photos or descriptions may occur if the manufacturer changes any characteristics or product contents. All descriptions are regularly and thoroughly checked.
TERMS OF SALE I) Concluding and Terminating the Sales Contract These Terms and the specific sales terms indicated alongside information about particular products constitute the Tinktura.com offer to conclude a Contract. By registering, placing an order, or otherwise accepting under these Terms, the user (as the buyer) accepts the offer, and a Contract between the user and tinktura d.o.o. is deemed concluded, pursuant to the sales terms set out herein. The subject and commercial purpose of the Contract is the purchase of a selected product or service via Tinktura.com in exchange for the appropriate fee (price). The Contract is concluded by means of distance communication (a distance contract) via: printed promotional messages with an order form, telephone (with or without human mediation), and the Internet. The Contract enters into force and is binding from the moment the user accepts the offer of tinktura d.o.o. in one of the following ways: by choosing a payment method and completing the order as a registered user of Tinktura.com, by choosing a payment method and completing the order via the 01 3733 563 phone line or by email received at info@tinktura.com. a) During registration or account creation, the user must choose a username under which services will be used and select a secure password, and provide a valid email address. All data required for registration/account creation must be truthful; using someone else’s data is expressly prohibited. b) When registering via a Facebook account to comment and actively participate on our Facebook profile, Tinktura.com may use your full name i.e., your Facebook account. c) Registration/user accounts are created for one person only and may not be shared with third parties. The user must keep their password and account details confidential. Use of another person’s registration or account is not allowed. d) For violations of the Terms in this section, tinktura d.o.o. reserves the right, at its sole discretion, to deactivate the user’s registration or account without any obligation to compensate the user for any costs or damages. e) By registering (which includes payment for the product and/or service), a Contract between tinktura d.o.o. and the user as the buyer is considered concluded. f) The Contract takes effect upon completion of user registration, i.e., from the day the user accepts the offer to conclude the Contract. g) Upon conclusion of the Contract, the user will receive: confirmation of the concluded Contract, the pre-contractual notice pursuant to Article 57(1) of the Consumer Protection Act (Official Gazette 41/2014, 110/15), these Terms, and a notice of the user’s right to unilateral termination of the Contract with the form for unilateral termination pursuant to Article 61(1) and (2) of the Consumer Protection Act. h) The user may unilaterally terminate the Contract within 14 (fourteen) days without giving any reason. The user has no right of unilateral termination if: the service has been fully performed with the user’s prior express consent and confirmation of being informed of the loss of the right to termination once the service is fully performed, the subject of the Contract is sealed goods not suitable for return due to health or hygiene reasons if unsealed after delivery, the subject of the Contract is goods which, due to their nature, are inseparably mixed with other items after delivery. To exercise the right of unilateral termination, the user must notify tinktura d.o.o. of the decision to terminate before the deadline, by an unambiguous statement sent by post (to tinktura d.o.o., Ivanićeva 10, 10000 Zagreb) or by email to info@tinktura.com, stating their name and surname, address, phone number or email address. The user may also use the prescribed termination form. The Contract Termination Form available at https://www.itspopjoy.com/images/uploads/obrazac-o-jednostranom-raskidu-ugovora.pdf may be completed and sent electronically, in which case tinktura d.o.o. will promptly deliver confirmation of receipt of the termination notice by email. The 14-day period runs from the day the goods are delivered into the possession of the user or a third person designated by the user (who is not the carrier), or, in the case of a service, from the conclusion of the Contract. If the conditions for unilateral termination are met, the user will be refunded the amount received from them, excluding delivery costs, without delay and no later than 14 days from the day tinktura d.o.o. (i.e., Tinktura.com) receives the user’s termination notice. The refund will be made so that the user does not incur any refund-related costs. tinktura d.o.o. may withhold the refund until the goods are returned and inspected for condition and eligibility for termination. The user must return or send the goods to tinktura d.o.o. (Tinktura.com), Malešnica Ulica 5/1, 10000 Zagreb, without undue delay and in any case no later than 14 days from the day the user notifies tinktura d.o.o. (i.e., Tinktura.com) of the termination. The user bears the direct cost of returning the goods. Cash-on-delivery return shipments will not be accepted. Before terminating the Contract, the user is kindly asked to call 01 3733 563 or write to info@tinktura.com to receive instructions on the return procedure. The user is responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functionality of the goods. In case of damaged original packaging, the refund amount will be reduced proportionally to the value of the goods; you will be notified in such a case. If, at the user’s request, performance of the service begins during the termination period, the user must pay tinktura d.o.o. an amount proportional to what has been provided until the moment tinktura d.o.o. was notified of the termination. II) Purchase Terms and Procedure The main characteristics of products, usage instructions, prices, special promotions and benefits, payment and delivery methods are those valid at the time the order is placed and will be indicated with each product. The product price and delivery fee (including VAT) are visible in the shopping cart before checkout. The delivery fee may also be displayed elsewhere on the site. All purchase confirmations based on electronic orders will be sent to the buyer’s email address provided during registration/ordering or entered at checkout. All prices are expressed in HRK and EUR. 1 EUR = 7.53450 HRK. VAT is included. The same itemized prices will be listed on the invoice delivered with the goods. III) Delivery and Delivery Terms a) Delivery cost is calculated automatically during purchase; your invoice will show both the product price and delivery price. b) Delivery within the Republic of Croatia is €4.00 for orders up to €53.09, and free for orders above €53.09, regardless of weight, volume, or address. Additional costs may apply for international shipping. More information on Delivery can be found HERE. c) For products marked as in stock, delivery across Croatia is 3–5 business days from order completion, according to DPD and other couriers’ schedules. d) For locations with special delivery regimes, the delivery time may be slightly longer (2–4 business days), per DPD and other couriers’ schedules. e) In case of changes to delivery times or other important circumstances affecting order fulfillment, our customer service will promptly inform the buyer.
IV) Claims and Complaints Ordered products are packaged to prevent damage during normal handling in transport/delivery. Each product is additionally protected with specialized shipping packaging. The buyer must inspect the package upon receipt. If the package shows visible damage/defects, we recommend refusing delivery, as the product inside may be damaged. Upon refusal, the courier will complete a Damage Report and return the shipment to Tinktura.com with a note that the shipment is defective. Claims regarding product defects and all other complaints may be submitted in writing by email or post: Email: info@itspopjoy.com Address: Tinktura d.o.o., Ivanićeva 10, 10000 Zagreb In case of a justified complaint, the buyer may request contract termination with a refund or exchange for the same product or another product of equal value (with additional payment or partial refund if necessary). If the complaint concerns damage and/or defects, the buyer should send a photo of the issue to info@itspopyoj.com so it can be validated based on subsequent physical inspection. If justified under the Obligations Act deadlines, Itspopjoy.com will arrange pickup of the damaged, defective, or incorrectly delivered goods at its own expense, provided the complaint is justified and the buyer did not cause the defect/damage. In such cases, Tinktura.com bears the full cost of replacing the product. In case of a dispute regarding the justification of the complaint and/or product authenticity, or if the buyer subjectively believes they did not receive an adequate product/service, it is common practice to report the case to a competent authority. The official body will perform all necessary checks to determine compliance with applicable laws. Upon a decision, both parties receive an official report, which is considered authoritative and sufficient to conclude the complaint process.
V) Payment Methods and Process Payment for products and delivery can be made by: a) Cash on delivery — pay the total amount shown on the invoice (including delivery) to the courier. b) Internet banking — after a successful order, Tinktura.com emails all necessary payment details. c) General payment slip — pay at banks, FINA, or Croatian Post offices; payment details are emailed after ordering. d) Credit/debit card — one-time online payment with American Express, MasterCard, Diners, Visa, or Maestro. Each method may include fees per the payment provider’s terms; these are borne by the payer and are non-refundable by tinktura d.o.o.. Card payments on Tinktura are secure! We use the WSPay internet payment service (WEB STUDIO d.o.o.), which employs state-of-the-art protection technologies such as SSL and other high-standard security procedures. Sensitive data exchange between the online payment system and card authorization centers uses a network fully protected from unauthorized access. Sensitive credit card data is sent online directly to the authorization center. Tinktura.com does not store your credit card data. Payment with foreign credit cards is not possible. Tinktura.com collects, processes, and publishes usage-related data without revealing user identity and/or personal data enabling identification. Tinktura.com collects and records users’ IP addresses or device locations for system administration, troubleshooting, download confirmation, or improving technical aspects of the service. Tinktura.com will automatically record usage habits, including page/content visit logs. Such data is used only to improve services and tailor promotional activities. Tinktura.com does not record your credit card number nor store transaction data. Card charges are processed by a third-party authorized bank using encryption.
COMMUNICATION WITH USERS By registering and purchasing, you consent to Tinktura.com contacting you via email for service/product promotion, notifications about content changes or additions, discounts, promotions, products, or changes in the provision of services. You may revoke this consent at any time.
VI) External Services Services provided by the Itspopjoy.com online store do not include costs you incur for the computer equipment and access services. Tinktura d.o.o. is not responsible for telephone or any other costs that may arise. Availability of the Itspopjoy.com online store: 24/7, 365 days a year. Although Itspopjoy.com strives to provide the best possible service, Tinktura d.o.o. cannot guarantee the services will meet your needs nor that the service will be error-free. Images are for informational purposes and may differ from the actual product if the manufacturer changes packaging design.
